Terms of Service

1. Description of service

Lumin is an AI visibility intelligence platform that helps agencies and brands monitor how large language models (LLMs) and AI assistants—including ChatGPT, Google Gemini, Anthropic Claude, and Google AI Overviews—reference and recommend their brand, products, and competitors. Features include share of voice analytics, citation intelligence, sentiment analysis, competitive benchmarking, and automated reporting.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. The Service is intended for business use only and is not directed at consumers acting in a personal capacity.

3. Accounts

• You must provide accurate and complete information when registering for an account.
• You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
• Notify us immediately at support@lumin-llm.com if you suspect unauthorised access to your account.
• You may not share your account credentials or allow others to access the Service through your account unless expressly permitted by your plan.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse engineer, decompile, or extract the source code of the Service.
• Use automated means (e.g. bots, scrapers) to access the Service beyond what is expressly provided through our API.
• Introduce malware, viruses, or any malicious code into the Service.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Attempt to gain unauthorised access to any part of the Service or its related systems.
• Use the Service to harass, abuse, or harm any person or organisation.
• Misrepresent your identity or affiliation with any person or organisation.
• Resell or sublicense the Service without our prior written consent.

5. Subscriptions and payment

Certain features of the Service require a paid subscription. By subscribing, you agree to the following:

• Fees — you agree to pay the fees specified at the time of purchase, plus any applicable taxes.
• Billing cycle — subscriptions are billed monthly or annually in advance as selected.
• Auto-renewal — subscriptions automatically renew at the end of each billing period unless cancelled.
• Cancellation — you may cancel at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period.
• Refunds — fees are non-refundable except as required by applicable law or as expressly stated in these Terms.
• Price changes — we may change subscription fees on 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

6. Beta access

During the beta period, certain features or access tiers may be offered free of charge. Beta features are provided "as is" without warranty. We reserve the right to modify, limit, or discontinue beta access at any time without notice and to transition free beta users to paid plans by providing reasonable advance notice.

7. Your data and content

You retain ownership of any data, keywords, brand configurations, or content you submit to the Service ("Your Content"). By submitting Your Content, you grant us a limited, non-exclusive, royalty-free licence to use, process, and store it solely to provide and improve the Service.

You represent and warrant that you have all necessary rights to submit Your Content and that it does not infringe any third-party rights or violate any applicable law.

8. Intellectual property

The Service, including all software, algorithms, data models, reports, interfaces, and content created by Lumin, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our express written permission.

9. Third-party services and AI models

The Service queries third-party AI models and platforms including OpenAI, Google, and Anthropic. We are not affiliated with or endorsed by these providers. The responses returned by AI models are generated by third-party systems and may change over time. Lumin does not guarantee the accuracy, completeness, or reliability of AI-generated outputs and makes no warranties about the behaviour of third-party AI models. Your use of any linked third-party services is subject to their respective terms and policies.

10. Confidentiality

Each party agrees to keep confidential any non-public information of the other party that is designated as confidential or that reasonably should be understood to be confidential. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. RESULTS OBTAINED THROUGH THE SERVICE ARE FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS THE SOLE BASIS FOR BUSINESS DECISIONS.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LUMIN AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) £100 GBP.

13. Indemnification

You agree to indemnify, defend, and hold harmless Lumin and its affiliates, officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

14. Suspension and termination

We may suspend or terminate your access to the Service at any time if:

• You breach these Terms and fail to remedy the breach within 7 days of written notice.
• You engage in conduct that we reasonably believe is fraudulent, harmful, or illegal.
• We are required to do so by law.

You may terminate your account at any time by cancelling your subscription and deleting your account. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive will survive termination.

15. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and cancel your subscription before the effective date.

16. Governing law and disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your jurisdiction require otherwise.

17. General

• Entire agreement — these Terms, together with our Privacy Policy, constitute the entire agreement between you and Lumin regarding the Service.
• Severability — if any provision is found to be unenforceable, the remaining provisions will continue in full force.
• Waiver — our failure to enforce any right or provision of these Terms is not a waiver of that right.
• Assignment — you may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations without restriction.
• Force majeure — we are not liable for delays or failures resulting from causes outside our reasonable control.
